Personal data processing is governed in particular by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing the Directive 95/46/EC (General Data Protection Regulation) (“GDPR”).

I. Personal Data Processing

A. Processing of personal data from contact form

If you enquire about our products and services, we will work with the contact data you provide us, mainly through the enquiry form or e-mail. This concerns: name, surname or company name, e-mail address, telephone number, your requirements for our products and services, or as the case may be, other data that you fill in or provide us in subsequent communications.

For what reason?

We contact you through these in order to make further arrangements regarding our products and services.

Based on what legal grounds?

The processing concerned is based on Art. 6 (1) b) of the GDPR – the negotiation and performance of agreements.

How long will we process the personal data?

Unless we establish further cooperation, we will process your personal data for no more than 12 months following our last communication.

B. Personal data processing as a consequence of the purchase of our products or services

If you purchase our products or services, we will work with the data you provide us. This mainly concerns invoicing data: name, surname, e-mail address, telephone number, residence address/registered office and data on the product or service or data associated therewith.

For what reason?

We need to process the personal data in order to fulfil our agreement – to provide you with the ordered products or services. We will also communicate with you using your personal data in matters concerning the order, the provision of services, or possible complaints or enquiries. 

We will also process your personal data to fulfil our obligations arising under law (mainly for accounting and tax purposes, or for handling complaints and other matters).

Based on what legal grounds do we process personal data?

The processing concerned is based on Art. 6 (1) b) of the GDPR – performance of agreements, and Art. 6 (1) c) of the GDPR – fulfilment of our obligations.

How long will we process the personal data?

For the duration of our service and thereafter for 10 years following the last provision of such service or delivery of the product.

C. Newsletters (commercial notifications)

If you subscribe to our newsletter or if you are our client and did not forbid us to do so, we may use your e-mail address for sending our newsletters.

Based on what legal grounds?

In the case of the newsletter subscription, the processing is based on your consent, i.e. Art. 6 (1) a) of the GDPR.

In case you are our client, we are allowed to do so based on Section 7 (3) of Act No. 480/2004 Coll., on certain services of the information society, unless you forbade us from doing so while receiving the services or goods.

The consent is voluntary and may be withdrawn at any time.

How long will we process the personal data?

2 years after granting consent or after receiving the last service. You can opt-out of the newsletter at any time via email, or by contacting us at: hello@thecompote.com

II. Who can access the data?

Your data will be stored with us. Having said that, we employ certain companies or enterprising individuals, who may access the data because they help us run our company. These include:

  • the providers of marketing and IT services (Jakub Vaculík);

  • the provider of the accounting and invoicing system and providers of accounting services (fakturoid);

  • companies participating in the dispatch of payments.

There is no designated data protection officer in our company.

The GDPR Regulation gives you inter alia the right to: contact us and request information concerning which elements of your personal data we process; request access to such data and to have this data updated or corrected, or as the case may be, request limitation of the processing thereof; request a copy of the processed personal data; in certain situations, request the erasure of your personal data; and in certain cases, the right to data portability. The granted consents may be withdrawn at any time and an objection may be filed against processing based on legitimate interest.

If you believe that we do not handle your data correctly, you are entitled to file a complaint with the Office for Personal Data Protection, or as the case may be, file a claim with the relevant court.
